2. Service Level Commitments & Availability

Provider guarantees a backbone Core Availability of 99.999% across all Tier-1 European optical corridors. Availability is measured continuously by synthetic packet injection between AMS-01 and destination points-of-presence. In the event of unscheduled service interruption exceeding 0.001% in any calendar billing period, Customer is entitled to automatic service credits as specified in the applicable Service Order.

3. Acceptable Use Policy (AUP)

Customer agrees to utilize Provider circuits strictly for lawful business purposes. Specifically, Customer shall not:
• Transmit unsolicited bulk communication (SPAM) or facilitate phishing networks.
• Conduct denial-of-service (DDoS) amplification attacks or packet floods.
• Originate unauthorized BGP route hijacks or fail to adhere to MANRS (Mutually Agreed Norms for Routing Security) routing hygiene.
• Violate export control laws or European Union regulatory sanctions.

4. BGP Peering & Routing Hygiene

Customer shall maintain valid RPKI Route Origin Authorizations (ROAs) for all announced prefixes. Provider enforces strict RPKI Origin Validation (ROV) and drops invalid routes at all ingress border gateways. Customer must also implement BCP38 anti-spoofing filters on all customer-facing network interfaces.

5. Limitation of Liability

To the maximum extent permitted under Netherlands law, Provider’s aggregate financial liability arising under or in connection with this Agreement shall be limited to the total fees paid by Customer in the three (3) calendar months preceding the claim event. Neither party shall be liable for indirect, consequential, or punitive damages.

6. Governing Law and Jurisdiction

This Agreement and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of the Netherlands, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The competent courts of Amsterdam, the Netherlands shall have exclusive jurisdiction to resolve any dispute.
